COMPREHENSIVE PRIVACY NOTICE FOR CLIENTS AND CLIENT REPRESENTATIVES

In compliance with the Federal Law on the Protection of Personal Data Held by Private Parties and its Regulations, this Privacy Notice is directed to the User(s) of the services and products offered by Dienes Cuchillas S.A. de C.V. (hereinafter, interchangeably referred to as “Dienes” or “Responsible Party”), with its address at Carretera a San Isidro Mazatepec Km. 1.2, Exterior Number 240 (Two Hundred Forty), Interior B (letter “B”), in the locality of Santa Cruz de las Flores, C.P. 45640 (Four Five, Six Four, Zero), in Tlajomulco de Zúñiga, Jalisco, United Mexican States, email ventas@dienesmex.com, and Website. For the purposes of this document, Dienes Cuchillas S.A. de C.V. will be responsible for the processing of your personal data, which may be collected through its Website in the United Mexican States, accessible through mobile devices, computers, and web browsers (hereinafter, the “Service”), or through emails ending in dienesmex.com and/or at the Dienes offices located at Carretera a San Isidro Mazatepec Km. 1.2, Exterior Number 240 (Two Hundred Forty), Interior B (letter “B”), locality of Santa Cruz de las Flores, C.P. 45640 (Four Five, Six Four, Zero), in Tlajomulco de Zúñiga, Jalisco, United Mexican States.
The information collected by the Responsible Party, consisting of Personal Data, may be collected at the time the Holder expressly consents to this Notice.
Likewise, the Holder is informed that all Personal Data will be managed in accordance with the principles of legality, consent, information, quality, purpose, loyalty, proportionality, and responsibility contained in the Federal Law on the Protection of Personal Data Held by Private Parties.
In this regard, the Holder will at all times be responsible for the Personal Data that you provide.
I. Definitions
In addition to the terms defined throughout this Notice, words that appear with the first letter capitalized in this document will have the meanings assigned to them below, regardless of their gender or number:
Notice.- Refers to this Comprehensive Privacy Notice, whether issued in physical, electronic, or any other format generated by the Responsible Party that is made available to the Holder prior to the processing of their personal data in order to comply with the principle of information.
Database.- The ordered set of personal data relating to an identified or identifiable person.
Consent.- The express acceptance made by the Holder regarding the Processing of their Personal Data in accordance with this Notice.
Cloud Computing.- The external provision model of on-demand computing services, which involves the supply of infrastructure, platform, or software, distributed flexibly through virtualization procedures, in dynamically shared resources.
Cookies.- Data file stored on the hard drive of a computer or electronic communication device of a user when browsing a specific internet site, which allows for the exchange of status information between that site and the user's browser. Status information may reveal means of session identification, authentication, or user preferences, as well as any data stored by the browser regarding the internet site.
Personal Data.- Any information concerning an identified or identifiable individual.
Sensitive Personal Data.- Personal Data that affects the most intimate sphere of its Holder, or whose improper use could give rise to discrimination or entail a serious risk for them. In particular, sensitive data is considered to include information revealing aspects such as racial or ethnic origin, present and future health status, genetic information, religious, philosophical, and moral beliefs, union affiliation, political opinions, or sexual preference.
ARCO Rights.- The rights that the Holder has before the Responsible Party, in relation to their Personal Data, which include the right to access their Personal Data and details of its processing, as well as to rectify them if they are inaccurate or cancel them when they are considered excessive or unnecessary for the purposes that justified their collection or oppose the Processing of the same for specific purposes. This will be expanded upon in section X (Roman Tenth) of this Notice.
Dissociation.- The procedure by which Personal Data cannot be associated with the Holder, nor allow their identification by their structure, content, or degree of disaggregation.
Processor.- The individual or legal entity that, alone or jointly with others, processes Personal Data on behalf of the Responsible Party.
Law.- Refers to the Federal Law on the Protection of Personal Data Held by Private Parties of the United Mexican States.
Guidelines.- Privacy Notice Guidelines published in the Official Gazette of the Federation on January 17, 2013.
Regulation.- The Regulation of the Federal Law on the Protection of Personal Data Held by Private Parties.
Responsible Party.- A private individual or legal entity that carries out the processing of Personal Data, namely Dienes.
Website: The one with the address www.dienesmex.com, owned by Dienes.
Third Party.- The individual or legal entity, national or foreign, different from the Holder or the Responsible Party of the Personal Data.
Holder.- The individual to whom the Personal Data corresponds.
II. Responsible Party for the Information
For the purposes of this Notice and for all legal effects, the Responsible Party will be Dienes Cuchillas S.A. de C.V., which will carry out the Processing of Personal Data.
The Responsible Party may be assisted by one or more Data Processors, who will act on behalf of the Responsible Party to provide more efficient processing of Personal Data. The Data Processors will be informed of the proper treatment to be given to Personal Data. As of the date of issuance of this Privacy Notice, no Data Processor is engaged, so the processing is entirely conducted by Dienes.
The Responsible Party may also process Personal Data using Cloud Computing systems, for which the service provider will be required to adhere to this Notice and comply with protection mechanisms and security measures intended to safeguard the information contained in Personal Data, in accordance with the Law, the Regulations, and other applicable legal provisions.
III. Information Collected Upon Subscribing to the Notice
This Notice is made available to the Data Subject on the Website and at Dienes' offices.
On the Website, in the "Contact" section, the Data Subject will provide the following information, which is considered essential to be able to provide and/or receive the services or products offered by Dienes:
- Full name;
- Email address;
- Company or workplace;
- Phone number.
If all the requested data is not provided, the Responsible Party will not be able to contact you.
Additionally, we inform you that on our website we use Cookies, Web Beacons, and other technologies through which it is possible to monitor your behavior as an Internet User, in order to provide you with better service and User experience when browsing the Website, as well as to offer you new products and services based on your preferences. When we collect data considered sensitive through our Website or any other electronic means, we will request that you sign this Notice using an application consisting of a Digital Electronic Signature, an Advanced Electronic Signature ("FEA") issued by the Tax Administration Service, or that you visit Dienes' offices to sign this Notice manually.
The Personal Data we obtain from these tracking technologies are as follows:
(i) Browsing time; (ii) time spent on our website; (iii) sections visited; and, (iv) websites accessed before ours.
If you request quotes or information about the products or services marketed by Dienes at its offices, this Notice will be made available to you. In particular, if any sensitive personal data is collected, your consent to this notice will be requested, for which you will be required to sign this Notice manually.
IV. Sensitive Personal Data
Sensitive Personal Data is considered to be any Personal Data that affects the most intimate sphere of its Data Subject, or whose misuse could lead to discrimination or pose a serious risk. Sensitive data include, in particular, those that may reveal aspects such as racial or ethnic origin, current and future health status, genetic information, religious, philosophical and moral beliefs, union membership, political opinions, or sexual preference.
If you contract any service or purchase any product offered by Dienes, certain information may be collected, which could include sensitive data, such as photographs of official identifications. Therefore, when contracting with Dienes, you must expressly authorize the use of your sensitive personal data to proceed with the process of delivering products and/or services by Dienes.
V. Primary and Essential Purposes of Processing
The Personal Data collected by the Responsible Party, whether in person at the offices, directly, indirectly through the Website, and/or through email communications, will be used for the following primary and essential purposes:
- To contact you in response to the request or query you, personally or as a representative, have submitted to us through the "Contact" section.
- To inform the Data Subject about any inconvenience with the Website;
- To maintain the necessary information to be able to maintain communication with Users and obtain feedback regarding any aspect of the service and/or products provided by the Responsible Party;
- To prepare legal documents for subscription between you and the Responsible Party;
- To prepare service, product, and logistics quotations;
- For identification purposes of the Data Subject to correctly channel their requests directed to Dienes; and
- To contact the Data Subject in case there has been a security breach at any stage of the Processing.
Compliance with the primary purposes of Processing is necessary for the existence, maintenance, and fulfillment of the legal relationship between the Responsible Party and the Data Subject.
VI. Secondary Purposes of Processing
The Personal Data collected by the Responsible Party, whether in person, directly, or indirectly, will be used for the following secondary purposes:
- Statistical and information purposes for the Responsible Party.
- Marketing, promotional, and commercial prospecting purposes.
- To contact the User sporadically and/or occasionally, in order to provide information related to the products and/or services provided by the Responsible Party, as well as other products for marketing, advertising, or commercial prospecting purposes.
If you do not wish for your Personal Data to be processed for any or all of the secondary purposes, you can inform us of this through the means provided in the Contact section.
VII. Transfers
After contracting any service or purchasing any goods manufactured and marketed by Dienes, the Responsible Party may transfer the User's Personal Data, with the express consent of the Data Subject, to the parent company Supe-Dienes GmbH, located at Kölner Str. 7, 51491 Overath, State of North Rhine-Westphalia, Federal Republic of Germany, as well as to any sister companies, business partners, or suppliers, in order to process your order for services and/or products with our parent company's legal and commercial department.

- Address;
- Bank account numbers;
- Official identifications (applicable to individuals with business activity, as well as representatives or attorneys of legal entities or individuals).
The Transfers described herein fall under the exception provided in Article 37, Section VII of the Law, as they are necessary to process your order for products or services and to complete the legal procedures required by domestic and foreign regulations.
Based on Article 37 of the Law, we inform you that your consent will not be required to make Transfers to controlling, subsidiary, or affiliated companies, or to a parent company or any company within the same group as Dienes, as these companies are governed by the same privacy standards.
If you do not wish for your Personal Data to be transferred, you must inform us of this through the means provided in the Contact section, in order to revoke your consent for any Transfer.
Additionally, Personal Data may be shared with third-party entities affiliated or related for commercial purposes, non-affiliated or unrelated third-party entities for commercial purposes, or any Third Party duly contracted, or any company with which the Responsible Party has a commercial relationship, as long as the referred Third Parties have adequate privacy controls, are aware of and sign this Notice, and only use the Personal Data to fulfill the purposes referred to in this Notice. To consent to the provisions of this paragraph, we make the following acceptance or non-acceptance clause for Transfers to Third Parties available to the Data Subject:
VIII. Limiting the Use or Disclosure of Your Personal Data
The Data Subject may indicate to the Responsible Party that they wish to limit or stop receiving advertising messages, whether by landline or mobile phone, as well as by email.
The Data Subject may also limit the purpose of the Processing. To do so, the Data Subject must send a request to disable secondary purposes, as well as purposes that are not essential, advertising messages, and/or emails to any of the contact means indicated in the Contact section.
To this end, the Data Subject must send a request with at least the following requirements:
- Full name of the Data Subject;
- Address or other means to communicate the response to your request;
- Official documents proving the identity of the Data Subject; and:
- A clear and precise description of whether they wish to limit or stop receiving advertising messages, whether by landline or mobile phone, as well as by email.
Additionally, the Data Subject may limit or stop receiving advertising messages by registering with the Public Registry of Consumers provided by the Federal Consumer Protection Law, now the Public Registry to Avoid Advertising.
Once the request is received, the Responsible Party will have a period of 20 (twenty) days to respond to the Data Subject, which will be sent through the contact means indicated by the Data Subject or, failing that, to the email address on record.
As for the Public Registry to Avoid Advertising, 1 (one) day after registration, it will take effect 30 (thirty) calendar days after the date of registration, and for the Public Registry of Users, it will take effect 45 (forty-five) days after registration and will remain in effect for 2 (two) years, after which it will be automatically deactivated.
IX. Revocation of Consent
The Data Subject has the right to revoke the Consent they have given for Processing, either concerning all or some of their Personal Data. To do so, the Data Subject must submit a request with at least the following requirements:
- Any element or document that facilitates the location of the Personal Data in question; and
- The method by which they wish to receive the response, whether in electronic documents, simple copies, or any other means.
If the Data Subject submits a rectification request, they must also indicate the modifications to be made and provide the documentation supporting their request.
If the request is granted, the response will be communicated within 15 (fifteen) days following the date the request was received. This period may be extended, with prior notice, for one additional period, provided the extension is justified.
The Responsible Party may deny access to Personal Data, or refuse to rectify, cancel, or grant opposition to the Processing of such data, in the following cases:
- When the applicant is not the Data Subject of the Personal Data, or the legal representative is not duly authorized to do so;
- When the Personal Data of the applicant
XI. Notice of Changes to the Policy.
The Data Controller may make modifications to this Policy, provided that the applicable legal provisions are respected. When modifications to the Policy are made, the Data Controller will make the information about the changes available to the Data Subject, along with the new Privacy Policy through the following means and procedures:
Via an email to the account that the User has registered;
Through physical distribution at the Data Controller's address; and/or
By publishing it on the Website or electronically.
The Data Controller reserves the right to change and update this Policy, and the Data Subject will be responsible for keeping their email account updated and ensuring that notifications are received in an inbox that is regularly checked. If there is no response from the Data Subject within seventy-two (72) hours, it will be understood that they accept the changes that may be made to this Policy.
We recommend that you periodically check the date of the last modification of this document.
